Terms and conditions of sale
Who sells, and to whom
The services presented under the name Papyan Digital are sold by MISSIONEO SAS (34 rue Laffitte, 75009 Paris, RCS Paris B 489 527 275), an umbrella employment company of the groupe ITG. Vahan Papyan, an employee of that company, designs and produces the work, and remains your contact from the first conversation to launch.
These terms apply to every order. Where the signed quote differs from them, the quote prevails.
Quote and order
- Every project is covered by a written quote setting out the scope, the pages, the languages, the number of revision rounds, the price and the timeline.
- The quote is valid for thirty days.
- The order is firm once the quote is signed and the deposit paid.
- Any request outside the written scope is covered by an additional quote, accepted before the work is carried out.
Prices
- The prices shown on this site are in euros, all taxes included, with French VAT at 20 % included.
- The price is firm: it does not move during the project, as long as the written scope does not change.
- The domain name is included in year one, then in upkeep or the monthly plan. Other costs the client takes on directly — licences, photography, licensed fonts — remain their responsibility and are stated before being incurred.
Payment
- The deposit is due on signature, at the launch of the project, not on delivery of the design.
- Presence and Growth: 50 % on signature, 50 % at launch. Bespoke: 40 % on signature, 30 % on approval of the design, 30 % at launch.
- Payment in full on signature is possible.
- On request, the Presence or Growth price can be paid in three instalments at no extra cost, following the schedule set out in the quote.
- Payment is made by bank transfer to MISSIONEO SAS, using the details shown on the invoice.
- Invoices are payable within thirty days of issue, unless the quote states otherwise.
In the event of late payment, penalties are due as of right, at the European Central Bank’s key rate plus ten points, together with a fixed recovery charge of forty euros for a business client. No discount is granted for early payment.
Monthly plan
Every package is offered either as a single payment or as a monthly plan, at the client’s choice, as stated in the quote. On a monthly plan, a reduced set-up fee is due on signature, followed by twelve monthly payments. 12-month commitment. At the end, the plan switches to upkeep at €19/month, no commitment, cancellable with 30 days’ notice.
- The monthly payment is taken automatically by card, on a fixed date agreed in the quote.
- It covers hosting, the domain name, backups, security updates and two changes per month, as defined below.
- During the twelve-month commitment, the site is hosted on the provider’s infrastructure.
- At the end of the twelve months, the site is paid off: the plan switches to upkeep at €19 per month, with no minimum term, unless the client chooses the Serenity plan or to leave. In every case, the files and the domain name are transferred to them free of charge on request.
- Stopping before the end of the twelve months makes the remaining monthly payments due, unless otherwise agreed in writing.
Timelines
- The stated timeline starts when the deposit and the content needed to begin have been received.
- Text, photographs and access expected from the client are provided within the time agreed in the quote.
- Past that point, the project is suspended and the current stage becomes payable. It resumes when the missing items arrive, subject to availability.
- Days spent waiting for the client’s approval are not counted in the stated timeline.
If the site does not go live on the date written in the quote for a reason attributable to the provider, the client receives 10% of the package price per full week of delay, up to 100% of that price, as a refund or a deduction from their invoice. A delay caused by the client (approval, content, information or payment expected from them) moves the go-live date accordingly and does not give rise to this refund.
Revisions
One revision round = a single list of requests, sent in one go, handled in one pass. The first round when the design is delivered, the second for the last corrections.
Beyond the number of rounds set out in the quote, requests are priced separately and carried out once agreed.
Delivery and launch
- The site is tested before delivery, on desktop and on phone.
- The client has seven days after launch to report anything that does not match the written scope; it is corrected at no charge.
- Without written feedback within that period, the work is deemed accepted.
- The domain name is registered in the client’s name. Ownership of the deliverables passes to them on payment in full.
Intellectual property
- On payment in full, the client becomes the owner of the text, visuals and pages produced for them, and is free to use them.
- Technical building blocks, components and reusable methods remain the property of the provider, who may use them on other projects.
- The client warrants that they hold the rights to the content they supply.
- No AI-generated image depicting a client’s premises, vehicles or boats is produced without their written agreement.
- The provider may name the project and show screenshots of it as a reference, unless the client objects in writing.
Hosting and maintenance
- In year one, hosting, the domain name, backups and one change per month are included, whatever the package.
- After that, the client chooses: upkeep at €19 per month (hosting, domain name, backups, security; a change costs €30), the Serenity plan at €80 per month, or the transfer of the site and the domain name to their name, free of charge.
- Upkeep and the Serenity plan are monthly, with no minimum term, cancellable in writing with thirty days’ notice.
- A change = one adjustment request handled in 30 minutes of work or less.
- Changes not used in a given month do not carry over to the next.
Cancellation and withdrawal
If the complete mockup of the site (all pages, made after the deposit) does not suit the client, they may withdraw from the project before any subsequent stage: the deposit or set-up fee already paid is refunded in full.
Beyond that stage, if the client withdraws from the project, the amounts corresponding to work already carried out remain due, and payments made are not refunded.
A client ordering outside any professional activity has fourteen days to withdraw, without giving a reason, by writing to [email protected]. If they ask for the work to begin before the end of that period, they make that request expressly and remain liable for what has been carried out by the date of their withdrawal. This right does not apply to orders placed for the purposes of a professional activity.
Liability
- The provider commits to the means employed and the care taken over the work, not to a commercial result.
- No search ranking, no volume of visits and no number of bookings are guaranteed: they depend on factors outside the site.
- The provider is not liable for interruptions caused by third-party services — host, registrar, search engines, booking tools.
- In the event of loss, compensation cannot exceed the amount actually paid for the service concerned.
- The client is responsible for the accuracy of the information published on their site, in particular their rates, their opening hours and their mandatory legal notices.
Confidentiality
Information, access credentials and documents exchanged during the project remain confidential on both sides. Credentials received are used solely for the purposes of the work, then returned or deleted at the client’s request.
Disputes
In the event of disagreement, the client writes first to [email protected]: an amicable solution is sought as a priority.
A consumer client may use a consumer mediator free of charge. The details of the competent mediator are provided on request at that same address. They may also file a complaint on the European online dispute resolution platform.
Failing agreement, the dispute falls to the French courts. This contract is governed by French law.
Language of these terms
This page is an English translation provided for convenience. The contractual version is the French one, which prevails in the event of any discrepancy.
